1. FareMachine collates information from third party suppliers about the flights, hotels, car rentals, cruises etc. FareMachine Endeavour’s is to provide correct information about the same but at the same time Faremachine cannot be held liable directly or indirectly for any information mismatch or last minute changes. FareMachine aims to provide all information about the flights, hotels, car rentals, cruises, vacation packages , visas, passports, baggage rules but these keep changing for time to time. The customer should keep himself updated and informed about any visa or travel related rules for any not limited to specific country or city or airlines or hotels or cruises.
You agree to indemnify, defend and hold harmless FareMachine, its parents, subsidiaries, shareholders, agents, affiliates, employees, directors and officers, from any and all liability, claim, loss, damage, demand or expense (including reasonable attorneys’ fees) (collectively, a “Claim”) asserted by any third party, including governmental entities, due to, arising from, or in connection with: (i) any breach by the Indemnifying Party of the terms of this Agreement, including, without limitation, any breach of any warranty or representation contained herein; and (ii) any gross negligence or willful misconduct committed by either party. The indemnifying party shall have the right to conduct the defense of any such Claim and all negotiations for its settlement or compromise; provided, however, that (a) no settlement or compromise affecting the financial or legal obligations of Indemnified party shall be agreed to without indemnified party’s prior written approval (such approval not to be unreasonably withheld), (b) the indemnified party shall have the right to participate, at its own expense, in the defense and/or settlement of any such Claim, and (c) the indemnified party notifies the indemnifying Party promptly of a Claim, provided that, failure to provide timely notice will not alter the indemnifying Party’s obligations except to the extent that the Indemnifying Party is materially prejudiced thereby.
3.Changes in Itenary
You have the right to change in itinerary in case of any emergency or any change of plan but such changes does not guarantee full refund or same fare as booked originally by the use.
4. RIGHT TO CANCELLATION and Right to Refuse by FareMachine IN CASE OF INVALID INFROMATION FROM USER.
FareMachine reserves the right to cancel any travel booking by you or right to refuse Travel booking if it feels the information provided by you is incorrect or fraudulent or does not abide by the laws of any country where you are bound to travel.
Any changes or cancellation or modification or refunds are subjected to fees both by the Supplier (Airlines, Hotels, Cruise, Car rentals etc) depending on the time the request is made and also depends on the itinerary, domestic or international. Any change in the itinerary is subjected to exchange which may vary depending on the Supplier terms, date of travel, time of change.
7. Governing Law
This Agreement shall be governed by and construed and enforced in accordance with the internal laws of the State of Illinois, without reference to the conflict of laws rules thereof, and the parties expressly consent that any dispute arising from or out of, or relating to this Agreement shall be resolved in the state or federal Court, as applicable, located in Chicago, IL.
Prices shown on the website are very dynamic in nature and are provided by suppliers. FareMachine cannot be held liable for any changes thereof for any price changes FareMachine will charge $50 for any new booking for Airlines and $30 for any new hotel bookings.
9. REPRESENTATIONS AND WARRANTIES
You warrant that all information provided by you is correct. You warrant that you are legally allowed age wise to do a travel booking with FareMachine as per the Governing laws of the country. You warrant that all information provided by you is correct and up to date.
10. Limitation of Liability
11.1 UNDER NO CIRCUMSTANCES YOU WILL HOLD FareMachine LIABLE TO OTHER FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL PUNITIVE OR EXEMPLARY DAMAGES (EVEN IF SUCH PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), ARISING FROM ANY ASPECT OF THE RELATIONSHIP PROVIDED HEREIN. IN ADDITION, IN NO EVENT WILL EITHER PARTY’S TOTAL OBLIGATIONS OR LIABILITY HEREUNDER EXCEED THE LESSER OF THE SPECIFIC CAMPAIGN IN QUESTION (AS SPECIFIED IN THE INSERTION ORDER) OR TEN THOUSAND DOLLARS ($5,000.00). REGARDLESS OF ANY LAW TO THE CONTRARY, NO ACTION, SUIT OR PROCEEDING SHALL BE BROUGHT AGAINST EITHER PARTY MORE THAN ONE YEAR AFTER THE DATE UPON WHICH THE CLAIM AROSE.
11.2 YOU HEREBY WAIVE FareMachine ITS RIGHT TO A JURY TRIAL. EACH PARTY ACKNOWLEDGES THAT THE OTHER PARTY HAS AGREED TO PRICING IN RELIANCE UPON THE LIMITATIONS OF LIABILITY AND THE DISCLAIMERS OF WARRANTIES AND DAMAGES SET FORTH HEREIN, AND THAT THESE CONSIDERATIONS FORM AN ESSENTIAL BASIS OF THE BARGAIN BETWEEN THE PARTIES. EACH PARTY AGREES THAT THE LIMITATIONS AND EXCLUSIONS OF LIABILITY AND DISCLAIMERS SPECIFIED IN THIS AGREEMENT WILL SURVIVE AND APPLY EVEN IF FOUND TO HAVE FAILED OF THEIR ESSENTIAL PURPOSE.
Any information which is deemed Confidential by FareMachine shall be maintained confidential by the user and shall not be disclosed unless as required by law or to serve the purpose of this agreement and the obligations of both the parties therein.
13.1 TICKET Errors DISCLAIMER
FareMachine is not responsible for any tickets that could not be issued or processed due to incomplete verification of credit card information, and/or credit card decline and/or due to technical glitches. No fare is guaranteed unless tickets are issued.
13.2 HUMAN ERROR
Any error made by any our employee or Agent will be looked into and Faremachine will try to get it rectified in reasonable time frame.
It is the duty of every passenger to reconfirm his flight bookings 24 hours prior to departure. You are free to contact Faremachine for any kind of assistance required in such a scenario.
13.4 Overbooking of Flight
In case the flight is overbooked, the airlines usually ask for volunteers who want to give up their booking for certain compensation. In case no volunteers are available, airlines usually gives priority as per the Priority Boarding rules of the Airlines. Anyone who misses the flight due to overbooking will be compensated as per the airlines policy.
13.5 All tickets which will be delivered to the customer will over the internet on their email ids and will be electronic in nature. Faremachine do not provide physical delivery of tickets.
