We at FareMachine act as an intermediary between you and the travel supplier as your booking agents. The following terms and conditions (the “Agreement”) covers the brochures and all booking made through us by you and can be changed from time to time.
1. Booking through our travel portal.
We claim no responsibility directly or indirectly for any last minute changes on the ticketing deals or information on our travel portal. FareMachine aims to provide all information about the flights, hotels, car rentals, cruises, vacation packages ,visas, passports, baggage rules but these keep changing for time to time The client should keep himself updated and informed about any visa or travel related rules. Certain software and content found on our website are owned or licensed by us or our Suppliers, your use of which may be subject to further conditions.
You agree to indemnify us and our affiliates, and any of our Suppliers, and any such parties’ officers, directors, employees and agents from and against any claims, causes of action, demands, losses, damages, or other costs, (including reasonable legal and accounting fees) brought by you or third parties as a result of (a) your breach of this Agreement, (b) your violation of any law or rights of any third party, including governmental entities, due to, arising from, or in connection with: (i) any breach by the Indemnifying Party of the terms of this Agreement, including, without limitation, any breach of any warranty or representation contained herein; and (ii) any gross negligence or willful misconduct committed by either party or (c) your use of our website.
3. Changes in Itinerary
You have the right to make changes in itinerary in case of any emergency or other unavoidable circumstances, but we do not assure you any guarantee on getting a full refund or reservations on the same fare booked originally by the user.
4. RIGHT TO CANCELLATION
The Customer is responsible to provide all the data or information accurately to FareMachine, in case of any incorrect details provided by you or in case of invalid information or fraudulent data, we reserve the right to cancel any booking or reservations without prior notice.
5. Exchange Fees
Any changes or cancellation or modification or refunds are subjected to fees both by the Supplier (Airlines, Hotels, Cruise, Car rentals etc) depending on the time the request is made and also depends on the itinerary, domestic or international. Any change in the itinerary is subjected to exchange which may vary depending on the Supplier terms, date of travel, time of change.
7. Governing Law
This Agreement shall be governed by and enforced in accordance with the internal laws of the State of Illinois, and the parties give consent that in case of a dispute arising from or out of, or relating to this Agreement shall be resolved in the state or federal Court, as applicable, located in Chicago, IL.
Prices that are reflected on the website prior to booking are provided by the suppliers and we just act as the booking agents, which can fluctuate at any given time. We do not claim any responsibility for any price changes before and at the time of booking.
FareMachine will charge $50 for any new booking for Airlines and $30 for any new hotel bookings.
9. Limitation of Liability
- We shall incur no liability whatsoever to the Customer or any Passenger in respect of any indirect, special, consequential, punitive or other damages (howsoever incurred).
- We are not responsible for any non-payment or failure to dispose any supply by Third Party to the customer or for any loss or damage, injury caused to the customer due to the acts of Third Party Supplier,
- Each party acknowledges that the other party has agreed to pricing in regard to the limitations of liability and the disclaimers of warranties and damages set forth therein.
Any information which is deemed “Confidential” by FareMachine shall be maintained confidential by the user and shall not be disclosed unless required by the law or to serve the purpose of this agreement and the obligations of both the parties therein.
11.1 TICKET Errors/ DISCLAIMER
FareMachine is not responsible for any tickets that could not be issued or processed due to incomplete verification of credit card information, and/or credit card decline and/or due to technical glitches. No fare is guaranteed unless tickets are issued.
It is the duty of every passenger to reconfirm his flight bookings 24 hours prior to departure. You can reach out to Faremachine for any kind of assistance needed in such situations and we will ensure that your queries are adequately resolved.
11.3 Overbooking of Flight
In case the flight is overbooked, the airlines usually ask for volunteers who want to give up their booking for certain compensation. In case no volunteers are available, airlines usually gives priority as per the Priority Boarding rules of the Airlines. Anyone who misses the flight due to overbooking will be compensated as per the airlines policy.
12. Late Payments
If any part of sum is due by the Customer, then we reserve the right to :
- Suspend all or part of the provision of the Arrangement Services to the Customer; and/or
- Cancel any bookings made by the Customer when payment is outstanding, including any cancellation charges, if any.
